当地时间2024年12月3日，第35届能源宪章会议法定会议上，《能源宪章条约》（ECT）现代化的决议正式通过。此次会议通过了以下四项决议：

1、《能源宪章条约》修正案（Amendments to the ECT as set out in Conference decision CCDEC202412）

2、《能源宪章条约》附件的修正案（Modifications and changes to the Annexes to the ECT as set out in the Conference decision CCDEC202413）

3、《能源宪章条约》谅解、声明和决议的修正案（Changes to Understandings, Declarations and Decisions with respect to the ECT as set out in the Conference decision CCDEC202414）

4、《能源宪章条约》修订案及附件修改的生效与临时适用条款（Provisions on the entry into force and provisional application of the adopted amendments to the ECT and approved changes to its Annexes as set out in the Conference decision CCDEC202415）

此次会议还批准了关于《能源宪章》现代化的官方公报以及现代化小组的最终报告。同时，自2025年2月2日起，能源宪章秘书处将在修正案生效前临时担任《能源宪章条约》的保存人。

会议补充：附件NI第A和B部分的修改将在2025年9月3日正式生效；修正案、附件NI第C部分的修改及其他附件的修改将在至少四分之三缔约方向保存人提交批准书、接受书或核准书后的第九十天生效，且仅在已批准的缔约方之间生效。

The Energy Charter Secretariat is pleased to announce that on 3 December 2024, the Energy Charter Conference adopted and approved the following decisions on the modernisation of the Energy Charter Treaty (ECT) at the Statutory Session of its 35th Meeting:

• Amendments to the ECT as set out in Conference decision CCDEC202412 (English, French, German, Russian, Spanish);

• Modifications and changes to the Annexes to the ECT as set out in the Conference decision CCDEC202413 (English, French, German, Russian, Spanish);

• Changes to Understandings, Declarations and Decisions with respect to the ECT as set out in the Conference decision CCDEC202414 (English, French, German, Russian, Spanish); and

• Provisions on the entry into force and provisional application of the adopted amendments to the ECT and approved changes to its Annexes as set out in the Conference decision CCDEC202415 (English, French, German, Russian, Spanish).

In addition to these decisions, the Conference approved its official Public Communication on the modernisation of the ECT as well as the Final Report of the Modernisation Group, which was dissolved following the successful conclusion of its mandate. It also designated the Energy Charter Secretariat as the Depository of the ECT, as of 2 February 2025, on an interim basis pending the entry into force of the amendments.

Note on applicability:

The amendments to the ECT, the modifications in Section C of Annex NI and the changes and modifications to other Annexes apply on a provisional basis from 3 September 2025. However, a Contracting Party may choose to opt out of such provisional application by serving to the Depositary a declaration to this effect before 3 March 2025.

The modifications in Sections A and B of Annex NI enter into force on 3 September 2025.

The amendments to the ECT, modifications in Section C of Annex NI and the changes and modifications to other Annexes enter into force on the ninetieth day after at least three-fourths of the Contracting Parties have deposited the instruments of ratification, acceptance or approval to the Depositary. The amendments and such changes and modifications shall enter into force between the Contracting Parties that have ratified, accepted or approved them.
