Application for Arbitration
When applying for arbitration, the Claimant shall submit to the Secretariat of CIETAC South China a Request for Arbitration in writing:
1. A Request for Arbitration shall include the following information: a. the names and addresses of the Claimant and the Respondent, including the zip code, telephone, telex, fax and telegraph numbers, email addresses or any other means of electronic telecommunications;
b. a reference to the arbitration agreement invoked; c. the claim of the Claimant; d. a statement of the facts of the case and the main issues in dispute and the facts and grounds on which the claim is based. The Request for Arbitration shall be signed and/or stamped by the Claimant and/or the attorney authorized by the Claimant.
2. Documentary evidences Documentary evidences on which the claimant’s claim is based, should be attached to the Request for Arbitration and to be numbered as Attachment 1,2,3…(the original one should be provided for examination in hearing.)
3.The registration certificate or personal identification The claimant’s business license, registration certificate or personal identification should be in five copies. If the claimant is from Hong Kong, Macao, Taiwan region or foreign countries, this relevant documents as well as Power of Attorney are suggested be notarized or attested.
4. Where the Claimant is a mainland company, it shall also submit its Legal Representative Certificate.
5. Where the Claimant is a mainland company who authorize a representative(s) to represent it, a Power of Attorney shall be submitted.
The above-mentioned documents should be submitted in five copies (if the number of the Respondents is more than two, additional copies shall be provided accordingly), if the arbitral tribunal is composed of only one arbitrator, the number of copies submitted may be reduced by two.
The Claimant shall pay in advance the arbitration fees and other actual expenses according to the CIETAC Arbitration Fee Schedule.
Note: The Claimant may submit the documents in person or mail them to the Secretariat of CIETAC South China.
